ORDINANCE NO. 4486
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF SIX
THOUSAND AND NO /100 ($6,000.00) DOLLARS TO OCEAN
CORPORATION FOR THE REPAIR OF THE CORNER SWEEP
MECHANISM OF THE MAIN CLARIFIER BOTTOM SLUDGE SCRAPER
AT THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, The corner sweep mechanism of the main clarifier bottom sludge
scraper at the Central District Wastewater Treatment Plant has suffered unforseen
damage; and
WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of
unforeseen damage to equipment, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of this equipment have been solicited,
and Ocean Corporation is the low estimate; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby
declares that an emergency situation exists.
Section 2: That payment to Ocean Corporation of SIX THOUSAND AND
NO /100 ($67000.00) DOLLARS as payment for repairs to the corner sweep mechanism
of the main clarifier bottom sludge scraper at the Central District Wastewater
Treatment Plant is hereby authorized.
Section 3: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 26th day of June, 1986.
