ORDINANCE NO. 4484
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AMENDING CHAPTER 14, "GARBAGE, TRASH
AND BRUSH;" BY ADDING SECTION 14 -1(d), "DEFINITIONS," SECTION
14 -4, "DISPOSAL OF TRASH," SECTION 14 -15, "CONFISCATION OF
IMPROPER CONTAINERS;" AND BY AMENDING SUBSECTION 14 -10,
"TIME OF COLLECTION," AND SECTION 14 -14, "COLLECTION OF
SPECIAL ITEMS;" REPEALING CONFLICTING ORDINANCES;
CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE
PUBLICATION AND EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the Code of Ordinances of the City of Baytown is hereby
amended by the amendment of Chapter 14, "Garbage, Trash and Brush," by adding
Section 14 -1(d), "Approved residential waste container," which shall read as follows:
Section 14 -1. Definitions.
(d) Approved residential waste container: (1) a metal can
with a tight - fitting lid not less than ten (10) gallons
nor more than thirty (30) gallons in size, that is
leakproof, having no jagged or sharp edges and not too
bulky to allow safe garbage collection or (2) plastic
or paper bags having a minimum thickness of 1.5 mil and
a capacity of not less ten (10) nor more than (30)
gallons. Such bags shall have a wet strength of at
least fifty (50) pounds.
Section 2: That the Code of Ordinance of the City of Baytown is hereby
amended by the amendment of Chapter 14, "Garbage, Trash and Brush," by adding
Section 14 -4, "Disposal of garbage," which shall read as follows:
Section 14 -4. Disposal of garbage.
Al garbage shall be disposed of only in approved
residential waste containers. Metal cans shall be
watertight of solid or durable grade of metal, of not more
than thirty (30) gallon capacity, with useable handles on
both sides. All cans shall have a close - fitting lid. Paper
or plastic bags shall not have more than a thirty (30)
gallon capacity and shall be closed by cord, wire or rubber
band, in such manner as to prevent leakage of the contents.
Section 3: The Code of Ordinances of the City of Baytown is hereby
amendea by the Amendment of Chapter 14, "Garbage, Trash and Brush," by the
adding of Section 14 -10, "Time of collection," which shall read as follows:
Section 14 -10. Time of Collection.
Garbage, trash or brush will be placed within the
street right -of -way by 7:30 o'clock a.m. on the day of
collection. All containers shall be removed from the street
right -of -way on the date of collection.
Section 4: That Section 14 -14 of the Code of Ordinances of the City of
Baytown, Texas, is hereby amended to read as follows:
Section 14-14. Collection of special items.

Collection of special items as described in Section
14 -7 shall be made by requesting special pickup service from
the Municipal Service Center. At special pickup service
shall be made within one week of the service request.
Section 5: That the Code of Ordinances of the City of Baytown is hereby
amended by the amendment of Chapter 14, Garbage, Trash and Brush," by adding
Section 14-15, "Confiscation of improper containers," which shall read as follows:
Section 14 -15. Confiscation of improper containers.
Any container which allows the contents to leak or fall
out or which has jagged or sharp edges which might cause
injury or any garbage container without a tight - fitting
cover is hereby declared to be a public nuisance and shall
be picked up and destroyed by the sanitation division.
Section 6: Ail ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 7: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 8: This Ordinance shall take effect from and after ten (10) days from
its passage
by the City Council. The City Clerk is
hereby
directed to give notice
hereof by
causing the caption of this ordinance
to be
published in the official
newspaper
of the City of Baytown at least twice
within
ten (10) days after the
passage of
this ordinance.
