ORDINANCE NO. 4467
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF
TWENTY -FOUR THOUSAND AND NO/100 ($24,000.00) DOLLARS TO
BAY TEMPERATURE CONTROL, INC. FOR THE REPAIR OF THE AIR
CONDITIONING SYSTEM AT THE CITY HALL ANNEX; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, The air conditioning system at the City Hall Annex has suffered
unforseen damage; and
WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of
unforeseen damage to equipment, the requirement for competitive bids is not
applicable; and
WHEREAS, informal bids for the repair of this equipment have been solicited,
and Bay Temperature Control, Inc. service is the low estimate; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby
declares that an emergency situation exists.
Section 2: That payment to Bay Temperature Control, Inc. of TWENTY -FUUR
THOUSAND AND N01100 ($24,000.00) DOLLARS as payment for repairs to the air
conditioning system at the City Hall Annex is hereby authorized.
Section 3: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 12th day of June, 1986.
