Ordinance No. 4,46760612 -2 ORDINANCE NO. 4467 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWENTY -FOUR THOUSAND AND NO/100 ($24,000.00) DOLLARS TO BAY TEMPERATURE CONTROL, INC. FOR THE REPAIR OF THE AIR CONDITIONING SYSTEM AT THE CITY HALL ANNEX; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, The air conditioning system at the City Hall Annex has suffered unforseen damage; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of unforeseen damage to equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of this equipment have been solicited, and Bay Temperature Control, Inc. service is the low estimate; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Bay Temperature Control, Inc. of TWENTY -FUUR THOUSAND AND N01100 ($24,000.00) DOLLARS as payment for repairs to the air conditioning system at the City Hall Annex is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
