Ordinance No. 4,45960522 -2 ORDINANCE NO. 4459 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING THE CODE OF ORDINANCES, SECTION 31 -58, "BILLING; PAYMENT; PENALTY; DISCONTINUANCE OF SERVICE," TO PROVIDE FOR DISCONTINUATION OF WATER SERVICE TWELVE DAYS AFTER THE PAYMENT DUE DATE; REPEALING INCONSISTENT ORDINANCES; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Subsection 31 -58(a) of the Code of Ordinances, City of Baytown, Texas, is hereby amended to read as follows: Sec. 31 -58. Billing; payment; penalty; discontinuance of service. (a) Meters shall be read monthly and each customer shall be billed monthly. Each water bill shall have a pre - calculated and stated due date, which shall be approximately fourteen (14) days from the day the bills are to be mailed. If a water account is not paid by such due date, the customer shall be charged a penalty in the amount of ten (10) percent of the amount of such water charge, which shall be shown as the gross amount on such bill. If the gross amount is not paid within twelve (12) days after the indicated due and payable date, the City reserves the right to terminate water service without further notice except as required by law and shall not restore service until the charges are paid, including reconnect charges. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circurstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
