ORDINANCE NO. 4439
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION
EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO
THOUSAND FOUR HUNDRED THIRTY -SEVEN AND 85/100 ($2,437.85)
DOLLARS TO HOUSTON SERVICE INDUSTRIES FOR REPAIR OF A
HOFFMAN BLOWER; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS, a Hoffman blower has suffered unforseen damage; and
WHEREAS, the immediate repair of this equipment is necessary for the
preservation and protection of the health and safety of the citizens of the City of
Baytown; and
WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of
unfdteseen damage to equipment or when it is necessary to protect the public health
and safety of the citizens, the requirement for competitive bids is not applicable;
and
WHEREAS, informal bids for the repair of this equipment have been solicited,
and Houston Service Industries is the low estimate; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby
declares that an emergency situation exists.
Section 2: That payment to Houston Service Industries of a maximum of TWO
THOUSANU FOUR HUNDRED THIRTY -SEVEN AND 85 /100 ($2,437.85) DOLLARS as
payment for the above described repairs to the Hoffman blower is hereby
authorized.
Section 3: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the April 24th day of April, 1986.
