Ordinance No. 4,38160213 -6 ORDINANCE NO. 4381 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF FOUR THOUSAND SEVEN HUNDRED SIXTY -FOUR AND 581100 ($4,764.58) DOLLARS TO WAUKESHA PEARCE INDUSTRIES, INC. FOR A SHORT BLOCK ENGINE ASSEMBLY FOR THE REPAIR OF THE BRUSH BURNING MACHINERY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the brush burning machinery has suffered unforseen damage; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that in case of unforeseen damage to public property, machinery, or equipment, the requirement for competitive bids is not applicable; and WHEREAS, informal bids for the repair of this machinery have been solicited, and Waukesha Pearce Industries, Inc. is the low estimate; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Waukesha Pearce Industries, Inc. of a maximum of FOUR THOUSAND SEVEN HUNDRED SIXTY -FOUR AND 581100 ($4,764.58) DOLLARS as payment for the above described repairs to the brush burning machinery is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
