Ordinance No. 4,37660213 -1 ORDINANCE NO. 4376 AN ORDINANCE AMENDING CHAPTER 27, "SUBDIVISIONS," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING SECTION 27 -22, "FILING FEES FOR PLATS;" PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Chapter 27, "Subdivisions," Section 27 -22, of the Code of Ordinances of the City of Baytown, Texas, is hereby amended to read as follows: SEC. 27 -22. Filing fee for plats. (a) Fee to accompany application. All applications to the commission for the approval of any proposed development shall be submitted to the planning and traffic department and shall be accompanied by a filing fee and in accordance with the following schedule and the commission shall not act upon any plat unless all fees as provided herein have been received. Residential: $150 plus $3 per lot or unit Commercial: $150 plus $10 per acre (b) Period of fees. These fees shall expire after a maximum time period between preliminary and final approval of one hundred eighty days or as provided elsewhere in this Chapter. (c) Vacation of subdivisions. Twenty -five dollars ($25.00) filing fee, plus fifteen dollars 15.00) per acre (gross area of whole tract), and in accordance with Section 5, Article 974a VTCS. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any Gerson or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect from and after ten (10) days from its passage by the City Council.
