Ordinance No. 4,32951126 -6 ORDINANCE NO. 4329 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND EIGHT HUNDRED SEVENTY -TWO AND 80/100 ($2,872.80) DOLLARS TO G. R. HALEY COMPANY AS THE SOLE SOURCE FOR- PARTS TO REPAIR THE SLUDGE PUMP AT THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the sludge pump at the Central District Wastewater Treatment Plant has suffered unforseen damage; and WHEREAS, the repair of the sludge pump is an integral part of providing municipal wastewater treatment necessary for the preservation and protection of the health, welfare, and safety of the citizens of the City of Baytown; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that when it is necessary to protect the public health of the citizens, the requirement for competitive bids is not applicable; and WHEREAS, the procurement of the parts for the sludge pump repair to meet the functional requirements of the City of Baytown can be satisfied by only one source, G. R. Haley Company; NOW THEREFORE, BE IT' ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to G. R. Haley Company, as the sole source, of TWU THOUSAND EIGHT HUNDRE=D SEVENTY -TWO AND 80/100 ($2,872.80) DOLLARS as payment for the above described parts for the Central District sludge pump is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
