ORDINANCE NO. 4321
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, ESTABLISHING A PRIMA FACIE SPEED LIMIT OF
40 MPH ON THE MAIN LANES AND 35 MPH ON FRONTAGE ROADS
DURING CONSTRUCTION ON INTERSTATE HIGHWAY 10;
PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO/100
($200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE
HEREOF.
WHEREAS, the State Department of Highways and Public Transportation has
made it known to the City of Baytown that operations will begin in the near future
to repair embankment slopes and construct U -turn lanes along a portion of Interstate
Highway 10; and
WHEREAS, in the interest of safety, it is desirable to maintain a construction
speed zone during the construction period; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the prima facia zone of 40 mph be established on Interstate
Highway 10 main lanes between the east city limit and the west city limit, during
construction to be effective when so signed within said zone.
Section 2: That a prima facia speed zone of 35 miles per hour be
established on Interstate Highway 10 frontage roads between the east city limit and
the west city limit, during construction to be effective when so signed within said
zone.
Section 3: That necessary signs for posting the herein established speed
zones will be furnished, installed, and maintained by the direction of the State
Department of Highways and Public Transportation Engineer in charge of this
project.
Section 4: Any person who shall violate any provision of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a
fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred
and NO /100 (`.6200.00) Dollars except minors who have passed their 14th birthday but
have not reached their 17th birthday shall be punished by a fine of not more than
One Hundred and NU /100 ($100.00) Dollars.

Section 5: This Ordinance shall take effect from and after ten (10) days from
its passage by the City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10) days after the
passage of this ordinance.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 14th day of November, 1985.
