Ordinance No. 4,301Published in: THE BAYTOVN SUN 51024 -8 Monday, October 28, 1985 Tuesday, October 29, 1985 ORDINANCE NO. 4301 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING THE DESIGNATION OF THE INTERSECTIONS OF WEST TEXAS AVENUE AND ASHBEL STREET, WEST TEXAS AVENUE AND GAILLARD STREET, AND WEST TEXAS AVENUE AND JONES STREET AS SIGNALIZED INTERSECTIONS; DESIGNATING THE INTERSECTIONS OF ASHBEL STREET AT WEST TEXAS AVENUE, GAILLARD STREET AT WEST TEXAS AVENUE AND JONES STREET AT WEST TEXAS AVENUE AS FLASHING STOP SIGNAL INTERSECTIONS; AUTHORIZING THE ADJUSTMENT OF THE SIGNAL DEVICES; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS FOR THE VIOLATION THEREOF; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, pursuant to the provisions of Article 6701d, Vernon's Texas Civil Statutes, does declare the following described intersections will no longer be signalized intersections, to -wit: West Texas Avenue and Ashbel Street West Texas Avenue and Gaillard Street West Texas Avenue and Jones Street Section 2: That the City Council of the City of Baytown, Texas, pursuant to the provisions of Article 6701d, Texas Revised Civil Statutes, does declare the following described intersections to be flashing stop signal intersections, to -wit: Ashbel Street at West Texas Avenue Gaillard Street at West Texas Avenue Jones Street at West Texas Avenue Section 3: The Director of Planning and Traffic is authorized and directed to cause the adjustment of the signal devices at the above described locations. Section 4: It shall be unlawful for a driver of a vehicle to disobey the instructions of the signals placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer. Section 5: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 6: if any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or 51024 -8a invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 7: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred and NO /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and NO /100 ($100.00) Dollars. Section 8: This ordinance shall take effect from and after ten (10) days after its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
