ORDINANCE NO. 4300
AN ORDINANCE DECLARING THAT NO SPECIAL BENEFITS WILL
ACCRUE TO THE PROPERTY ABUTTING MASSEY - TOMPKINS ROAD
AND THE OWNERS OF SAID PROPERTY BY REASON OF THE
MASSEY- TOMPKINS STREET IMPROVEMENT PROJECT; PROVIDING
THAT WORK MAY BEGIN UPON SUCH STREET IMPROVEMENT
PROJECT; DIRECTING THE CITY CLERK TO FILE A RELEASE TO A
CERTAIN NOTICE WITH THE COUNTY CLERK; AND PROVIDING FOR
THE EFFECTIVE DATE HEREOF.
WHEREAS, that by Ordinance No. 4167 duly adopted and approved on the
13th day of June, 1985, the City Council of the City of Baytown did determine the
necessity for and ordered the permanent improvement of the following named street
in the City of Baytown within the following limits, to -wit:
Massey - Tompkins Road from the east right -of -way line of North Main
Street to a point located 590 feet east of the east right -of -way line of
North Main Street; and
WHEREAS, that said City Council, after having duly advertised for bids in the
manner and for the time as required by law and the charter of said city did award
to, and execute a contract with Eiserer Construction Company, for the construction
of said improvement as authorized by Ordinance No. 4249 duly enacted on the 12th
day of September, 1985; and
WHEREAS, that the City's consulting engineers, were instructed by the City
Council to prepare a proper statement of the estimates of the amounts per front
foot proposed to be assessed against the property abutting thereon and the owners
thereof, should special benefits to such property and its owners in the enhanced
value thereof, accrue as a result of such improvements; and
WHEREAS, that the City Council hereby declares that no special benefits to
such property and its owners in the enhanced value thereof, will accrue as a result
of such improvements; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF 1-HE CITY OF BAYTOWN,
TEXAS:
Section 1: That no levy, assessment, or tax shall be made against the
respective parcels of property abutting upon said street and against the real and
true owners thereof, by reason of the Massey - Tompkins Street Improvement Project.
Section 2: That work may begin on this street improvement project.
Section 3: That the City Clerk is hereby directed to file a release to the
"Notice of assessment proceeding and lien for street improvements," upon adoption
of this ordinance with the County Clerk of Harris County, Texas.

Section 4: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
