Ordinance No. 4,27250926 -6 ORDINANCE NO. 4272 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING PAYMENT OF SIX THOUSAND THREE HUNDRED FIFTY -SIX AND NO /100 ($6,356.00) DOLLARS TO THE STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION FOR THE COSTS OF UTILITY ADJUSTMENTS ON STATE HIGHWAY 146 AND LOOP 201. WHEREAS, the City Council of the City of Baytown, Texas, heretofore adopted Ordinance No. 3986 authorizing an agreement with the State Department of Highways and Public Transportation for joint use by the City of Baytown of highway right -of -way for utility purposes on State Highway 146 and Loop 201; and WHEREAS, pursuant to the terms of such an agreement the City of Baytown is responsible for the cost of adjusting, removing, or relocating the utilities within the right -of -way; and WHEREAS, the State Department of Highways and Public Transportation submitted a cost estimate in the amount of SIX THOUSAND THREE HUNDRED FIFTY -SIX AND NO /100 ($6,356.00) DOLLARS for the cost of the State Highway 146 and Loop 201 utility and pipeline adjustments; and WHEREAS, the cost of such adjustments would be greater if undertaken by the City or a City of Baytown contractor; and WHEREAS, the City Council of the City of Baytown desires to authorize payment of said costs; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes payment of SIX THOUSAND THREE HUNDRED FIFTY -SIX AND NO /100 ($6,356.00) DOLLARS to the State Department of Highways and public Transportation for the costs of utility adjustments on State Highway 146 and Loop 201 right -of -way. A copy of the estimate for said costs is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: That this ordinance shall take effect from and after its passage by the City Council of the City of Baytown. The increased costs incurred by placing the junction boxes will be paid by the City of Baytown.
