ORDINANCE NO. 4245
AN ORDINANCE ESTABLISHING A PRIMA FACIE SPEED LIMIT OF 20
MILES PER HOUR FOR MOTOR VEHICLES IN SCHOOL ZONES;
PROVIDING FOR HOURS OF ENFORCEMENT ON SCHOOL DAYS;
DESIGNATING SCHOOL ZONES; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100
($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the prima facie maximum speed limit with respect to Junior
High school zones during any day school is in session is 20 miles per hour between
the hours of 7:30 a.m. and 8:00 a.m. and the hours of 3:00 p.m. and 3:30 p.m.; and
City Council hereby determines and declares this prima facie speed limit to be
reasonable and prudent.
Section 2: That the following locations are designated Junior High school
zones to which said prima facie maximum speed limit shall apply, to -wit:
South Pruett between American and Casey
Elvinta between East Elvinta and Cedar Bayou Road
Cedar Bayou Road between East Elvinta and the eastern school
property line
Bayway Drive between Honeysuckle and 600 feet south of Post
Oak
Section 3: That the prima facie maximum speed limit with respect to
Elementary school zones during any day school is in session is 20 miles per hour
between the hours of 8:00 a.m. and 9:00 a.m. and the hours of 3:00 p.m. and 4:00
p.m.; and the City Council hereby determines and declares this prima facie speed
limit to be reasonable and prudent.
Section 4: That the following locations are designated Elementary school
zones to which said prima facie maximum speed limit shall apply, to -wit:
Robin Road between Lazy Lane and HCFC Ditch
East Homan between Austin and Dallas
Austin between Homan and Alva
East James between North Third and North Sixth
Clayton between Mockingbird and the north edge of school
property
Lee Drive between Stella and Dailey
Carver Street between Lee and western edge of school property
North Pruett between West Lobit and Green Avenues
Fairway between 220 feet south of Inverness and Somerset
Baker between Hemlock and Village Lane
Virginia between Georgia and New Jersey
Kentucky between Georgia and Carolina
Georgia between Kentucky and Virginia
Massey- Tompkins between the eastern edge of school property
and western edge of school property

Section
5:
The Director of Planning and Traffic is hereby authorized and
directed to cause
the proper signs to be posted at the
above described location.
Section
6:
It shall be unlawful for a driver
of a vehicle to disobey the
instructions of
the
signs placed in accordance with the
provisions of this ordinance,
unless at the time
otherwise directed by a police officer or traffic control signal.
Section
7:
All ordinances or parts of ordinances
inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 8: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 9: Any person who shall violate any provision of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a
fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred
and NO /100 ($200.00) Dollars except minors who have passed their 14th birthday but
have not reached their 17th birthday shall be punished by a fine of not more than
One Hundred and NO/100 ($100.00) Dollars.
Section 10: This Ordinance shall take effect from and after ten (10) days
from its passage by the City Council. The City Clerk is hereby directed to give
notice hereof by causing the caption of this ordinance to be published in the
official newspaper of the City of Baytown at least twice within ten (10) days after
the passage of this ordinance.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 22nd day of August, 1985.
