Ordinance No. 4,23150813 -18 ORDINANCE NO. 4231 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS, AUTHORIZING THE PAYMENT OF THE SUM OF TWO THOUSAND FOUR HUNDRED FORTY -EIGHT AND NO /100 ($2,448.00) DOLLARS TO HOUSTON SERVICE INDUSTRIES FOR REPAIR WORK TO A HOFFMAN BLOWER; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the Hoffman blower at the Central District Wastewater Treatment has suffered unforseen damage; and WHEREAS, the repair of this blower so that the wastewater treatment can provide municipal sewer service is necessary for the preservation and protection of the health, welfare, and safety of the citizens of the City of Baytown; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that when it is necessary to protect the public health of the citizens, the requirement for competitive bids is not applicable; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That payment to Houston Service Industries of the sum of TWO THOUSAND FOUR HUNDRED FORTY -EIGHT AND NO/100 ($2,448.00) DOLLARS as payment for the above described repair work to the Hoffman blower at the Central District Wastewater Treatment Plant is hereby authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
