Ordinance No. 4,20950725 -9 ORDINANCE NO. 4209 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS; AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT FOR THE EMERGENCY SLIPLINING OF 482 FEET OF TWELVE INCH SERVER LINE BETWEEN GREEN13RIAR DRIVE AND THE INTERSECTION OF LAKEWOOD DRIVE AND MAYHAW DRIVE; AND APPROVING PAYMENT OF THE SUM OF EIGHT THOUSAND NINETY -SEVEN AND 601100 ($8,097.60) DOLLARS. WHEREAS, 482 feet of twelve inch sewer line between Greenbriar and the intersection of Lakewood Drive and Mayhaw Drive is in a state of disrepair due to pipe deterioration and resulting cave -ins; and WHEREAS, TEX. REV. CIV. STAT., art. 2368a provides that when it is necessary to appropriate money at once to protect the public health of the citizens, the requirement for publishing notice and taking competitive bids is not applicable; and WHEREAS, the City administration has taken informal bids for the cost of the repair work, and submitted the low bid; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby declares that an emergency situation exists. Section 2: That the City Manager of the City of Baytown is hereby authorized and directed to enter into a contract with Channel Construction Company, Inc. for the emergency sliplining of 482 feet of sewer line between Greenbriar Drive and the intersection of Lakewood Drive and Mayhaw Drive and payment of EIGHT THOUSAND NINETY -SEVEN AND 601100 ($8,097.60) DOLLARS is authorized. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
