Ordinance No. 4,189Published in: THE BAYIUVN SUN 50627 -10 Thursday, July 4, 1985 Friday, July 5, 1985 ORDINANCE NO. 4189 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE INSTALLATION OF A TRAFFIC- CONTROL SIGNAL AT THE INTERSECTION OF BAKER ROAD AND GOOSE CREEK DRIVE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Texas Revised Civil Statutes article 6701d provides that local authorities in their respective jurisdiction may place and maintain any traffic- control device upon any highway under their jurisdiction as they may deem necessary to regulate, warn, or guide traffic; and WHEREAS, the City Council of the City of Baytown, Texas, deems it necessary to regulate, warn, or guide traffic at the intersection herein described; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The following described intersection shall be a signalized intersection and to be controlled by a traffic - control signal, to -wit: Baker road and Goose Creek Drive Section 2: The Director of Planning and Traffic is hereby authorized and directed to cause the installation and maintenance of the traffic - control signal at the above prescribed location. Section 3: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 4: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. 50627 -10a Section 5: It shall be unlawful for a driver of a vehicle to disobey the instructions of the traffic - control device placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer or traffic- control signal. Section 6: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and No /100 ($1.00) Dollar nor more than Two Hundred and IVo /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and N0/100 ($100.00) Dollars. INTRODUCED, READ, and PASSED by the Section 7: This Ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
