Ordinance No. 4,18150627 -2 ORDINANCE NO. 4181 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 7, "BUILDINGS," SECTION 7 -4.1, BUILDING CODE -- AMENDMENTS, BY ESTABLISHING BUILDING CONSERVATION DISTRICTS; REPEALING CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 7, "Buildings," Section 7 -4.1, Building Code -- Amendments which shall read as follows: Sec. 7 -4.1. Building Code -- Amendment. Section 101.5.1, Building Conservation Districts shall be added as follows: Section 101.5.1. Building Conservation Districts. The provisions of this code relating to the construction alteration, repair, enlargement, restoration, relocation or moving of buildings or structures shall not be mandatory for existing buildings or structures located within a Building Conservation District when such buildings or structures are judged by the building official to be safe and the public health, safety and welfare will not be detrimentally effected by the proposed construction, alteration, repair, enlargement, restoration, relocation or moving of buildings within the district. A Building Conservation District may be created by City Council upon their determination that creation of such a district will help restore structures and such restoration will provide a public benefit. The applicant for a building permit for a new structure within a Building Conservation District must submit complete architectural or engineering plans and specifications bearing the seal of a registered professional engineer or architect. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or 50627 -2a invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
