ORDINANCE NO. 4168
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, PROVIDING THAT A PORTION OF A FIRE LANE AND A
UTILITY EASEMENT BE VACATED, ABANDONED AND CLOSED;
PROVIDING FOR THE EXCHANGE OF EASEMENTS; PROVIDING FOR
THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, there is a certain dedicated fire lane easement and utility
easement which run along the north part of Willowcreek Shopping Center, Phase I;
and
WHEREAS, the Brienwolf Corporation is the abutting land owner and has
made application that a portion be discontinued, closed and abandoned as a
dedicated fire lane and utility easement; and
WHEREAS, the Brienwolf Corporation has made in exchange of such
easements, a fire lane easement along the west part of Willowcreek Shopping
Center, Phase I and I1; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The utility easement to be abandoned is described as a ten (10)
feet wide and one hundred seventy -nine (179) feet long water line easement. A map
of such easement to be abandoned is attached hereto and marked Exhibit "A."
Section 2: The fire lane easement to be abandoned is described as a
twenty -eight (28) feet wide and one hundred seventy -nine (179) feet long fire lane
easement. A map of such easement to be abandoned is attached hereto and marked
Exhibit "B."
Section 3: That the portion of the dedicated fire lane easement and utility
easement described above are hereby closed, abandoned and permanently vacated as
dedicated easements.
Section 4: That the City of Baytown hereby accepts in exchange for such
easements, a twenty -eight (28) feet wide and three hundred eighty (380) feet long
fire lane easement along the west part of Willowcreek Shopping Center, Phase I and
II, as shown in Exhibit "C."
Section 5: That the interest or interests of the City and /or public in the
above described portion of said easements (and as shown in Exhibit "A" and "B"
attached hereto) is hereby quitclaimed to the adjacent owner for and in
consideration of such exchange of easements for equal or greater value.

Section 6: That the Mayor and City Clerk are hereby authorized to execute
such instruments, if any, necessary for such abandonment and sale.
Section 7: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 13th day of June, 1985.
