Ordinance No. 4,09750314 -3 ORDINANCE N0. 4097 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, REPEALING ORDINANCE NO. 4079; AUTHORIZING THE SALE OF ABANDONED VEHICLES HELD BY THE CITY OF BAYTOWN TO THE SECOND HIGH BIDDER FOR THE SALE PRICE OF ONE THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100 ($1,538.00) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, seventy -three (73) abandoned vehicles held by the City were advertised for sale in the local newspaper pursuant to provisions of Section 73 of the Charter of the City of Baytown; and WHEREAS, all bids were opened and publicly read at City Hall at 2:00 P.M., Thursday, February 7, 1985; and WHEREAS, Ordinance No. 4079 awarded the bid to the high bidder, Lister's Salvage; and WHEREAS, due to a change in condition of the vehicles, the high bidder has withdrawn its bid, but the second high bidder will still honor its bid; and WHEREAS, the second highest and best bid for the abandoned vehicles was ONE THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100 ($1,538.00) DOLLARS; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That Ordinance No. 4079, awarding the bid to Lister's Salvage, is repealed. Section 2: That the City Council of the City of Baytown hereby accepts the bid of Cleveland Auto and Truck Salvage for the purchase of seventy -three (73) abandoned vehicles described in the bid specifications for the sales price of ONE THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100 ($1,538.00) DOLLARS. Section 3: That the City Manager and City Clerk are hereby authorized to sign such documents as are necessary to transfer these abandoned vehicles to Cleveland Auto and Truck Salvage. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
