ORDINANCE N0. 4097
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, REPEALING ORDINANCE NO. 4079; AUTHORIZING
THE SALE OF ABANDONED VEHICLES HELD BY THE CITY OF
BAYTOWN TO THE SECOND HIGH BIDDER FOR THE SALE PRICE OF
ONE THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100
($1,538.00) DOLLARS; AND PROVIDING FOR THE EFFECTIVE DATE
HEREOF.
WHEREAS, seventy -three (73) abandoned vehicles held by the City were
advertised for sale in the local newspaper pursuant to provisions of Section 73 of
the Charter of the City of Baytown; and
WHEREAS, all bids were opened and publicly read at City Hall at 2:00 P.M.,
Thursday, February 7, 1985; and
WHEREAS, Ordinance No. 4079 awarded the bid to the high bidder, Lister's
Salvage; and
WHEREAS, due to a change in condition of the vehicles, the high bidder has
withdrawn its bid, but the second high bidder will still honor its bid; and
WHEREAS, the second highest and best bid for the abandoned vehicles was
ONE THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100 ($1,538.00)
DOLLARS; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That Ordinance No. 4079, awarding the bid to Lister's Salvage, is
repealed.
Section 2: That the City Council of the City of Baytown hereby accepts the
bid of Cleveland Auto and Truck Salvage for the purchase of seventy -three (73)
abandoned vehicles described in the bid specifications for the sales price of ONE
THOUSAND FIVE HUNDRED THIRTY -EIGHT AND NO/100 ($1,538.00) DOLLARS.
Section 3: That the City Manager and City Clerk are hereby authorized to
sign such documents as are necessary to transfer these abandoned vehicles to
Cleveland Auto and Truck Salvage.
Section 4: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 14th day of March, 1985.
