Ordinance No. 4,09350228 -11 ORDINANCE N0. 4093 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION EXISTS; ACCEPTING THE BID OF JAY MARKS CHEVROLET FOR THE REPLACEMENT OF A GASOLINE ENGINE FOR A GARBAGE TRUCK AND AUTHORIZING THE PAYMENT BY THE CITY OF BAYTOWN OF THE SUM OF TWO THOUSAND TWENTY -FIVE AND NO /1130 ($2,025.00) DOLLARS. WHEREAS, due to unforeseen damage to the engine in a side loader garbage truck, said truck is presently not operable; and WHEREAS, the garbage truck is necessary for the proper and timely collection of garbage within the city; and WHEREAS, TEX. REV. CIV. STAT., article 23682 provides that in case of unforeseen damage to public property, machinery or equipment, the requirement for competitive bids is not applicable; and WHEREAS, the administration has taken informal bids for the necessary repair work; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council hereby declares that due to unforeseen damages to a side loading garbage truck, an emergency exists. Section 2: That the City Council of the City of Baytown hereby accepts the bid of Jay Marks Chevrolet for the replacement of a gasoline engine for a side loading garbage truck for the sum of TWO THOUSAND TWENTY -FIVE AND N0/100 ($2,025.00) DOLLARS, and authorizes payment thereof. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
