ORDINANCE N0. 4093
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITUATION
EXISTS; ACCEPTING THE BID OF JAY MARKS CHEVROLET FOR THE
REPLACEMENT OF A GASOLINE ENGINE FOR A GARBAGE TRUCK
AND AUTHORIZING THE PAYMENT BY THE CITY OF BAYTOWN OF
THE SUM OF TWO THOUSAND TWENTY -FIVE AND NO /1130 ($2,025.00)
DOLLARS.
WHEREAS, due to unforeseen damage to the engine in a side loader garbage
truck, said truck is presently not operable; and
WHEREAS, the garbage truck is necessary for the proper and timely
collection of garbage within the city; and
WHEREAS, TEX. REV. CIV. STAT., article 23682 provides that in case of
unforeseen damage to public property, machinery or equipment, the requirement for
competitive bids is not applicable; and
WHEREAS, the administration has taken informal bids for the necessary repair
work; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council hereby declares that due to unforeseen
damages to a side loading garbage truck, an emergency exists.
Section 2: That the City Council of the City of Baytown hereby accepts the
bid of Jay Marks Chevrolet for the replacement of a gasoline engine for a side
loading garbage truck for the sum of TWO THOUSAND TWENTY -FIVE AND N0/100
($2,025.00) DOLLARS, and authorizes payment thereof.
Section 3: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 28th day of February, 1985.
