ORDINANCE NO. 4045
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, ESTABLISHING A PRIMA FACIA SPEED LIMIT
DURING CONSTRUCTION ON LOOP 201 BETWEEN DORRIS STREET
AND THE SOUTHERN PACIFIC RAILROAD; PRESCRIBING A
MAXIMUM PENALTY OF TWO HUNDRED AND NO/100 ($200.00)
DOLLARS FOR EACH VIOLATION THEREOF; AND PROVIDING FOR
THE PUBLICATION AND EFFECTIVE DATE HEREOF.
WHEREAS, the State Department of Highways and Public Transportation has
made it known to the City of Baytown that operations will begin in the near future
to install structures, concrete pavement, traffic signals, signing, safety lighting, and
roadway delineation along a portion of Loop 201; and
WHEREAS, in the interest of safety, it is desirable to maintain a construction
speed zone during the construction period; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the prima facia zone of 30 mph be established on Loop 201
between Dorris Street and the southern Pacific Railroad, during construction to be
effective when so signed within said zone.
Section 2: That a prima facia speed zone of 30 miles per hour be
established on Loop 201 between the Southern Pacific Railroad Crossing and Ferry
Road, etc.
Section 3: That the prima facia speed zone shall revert to the present
prima facia speed zones when construction is completed, to be effective when so
signed within said zone;
Section 4: That necessary signs for posting the herein established speed
zones will be furnished, installed, and maintained by the direction of the State
Department of Highways and public Transportation Engineer in charge of this
project.
Section 5: Any person who shall violate any provision of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a
fine of not less than One and NO/100 ($1.00) Dollar nor more than Two Hundred
and NO /100 ($200.00) Dollars except minors who have passed their 14th birthday but
have not reached their 17th birthday shall be punished by a fine of not more than
One Hundred and NO/100 ($100.00) Dollars.

Section b: This Ordinance shall take effect from and after ten (10) days from
its passage by the City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10) days after the
passage of this ordinance.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 10th day of January, 1985.
