REV. GIV. STAT. art. 5421c -12 provides that any land or interest therein, which was originally acquired for the purpose of streets, rights -of- way or easements which the political subdivision chooses to trade or exchange as consideration for other land acquired for streets, rights -of -way or easements, including transactions which may be partly for cash and partly by trade or exchange may be without necessity of procedures and publication requ.rements applicable in the sale of disposal of real property interests belonging to a political subdivision; and WHEREAS, as art. 5421c-12 further provides that any conveyance, sale or trade made pursuant to the provisions thereof shall never be made for less than the fair market value of the land or interest in the land being conveyed, sold or traded, as determined by appraisal, which appraisal shall be conclusive of the fair market value; and WHEREAS, Tax Assessor - Collector of the City of Baytown has made an appraisal of the lands and other valuable consideration to be exchanged by the City of Baytown and the Goose Creek Consolidated Independent School District and has determined that the fair market value of the lands and interest and other valuable consideration to be acquired by the City of Baytown is not less than the fair market value of the lands and interest to be conveyed to Goose Creek Consolidated Independent School District by the City of Baytown; NOW TH FORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the appraisal of the Tax Assessor - Collector of the City of Baytown which is attached hereto marked Exhibit "A." 101 Section 2: That the City Council of the City of Baytown does hereby authorize the exchange of land owned by the City of Baytown, Texas, described in Exhibit "B," ctteched hereto, for land owned by the Goose Creek Consolidated C] v Section 3: That the City Council of the City of Baytown hereby accepts the deed to the property described in Exhibit "C" hereto from the Goose Creek Consolidated Independent School District in consideration for the conveyances of the property described in Exhibit "b."
