ORDINANCE NO. 4024
AN ORDINANCE AMENDING CHAPTER 7, "BUILDINGS," REPEALING
CONFLICTING ORDINANCES; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF. •
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1 : That Section 7-6 of the Code of Ordinances of the City of
Baytown is hereby amended to read as follows:
Sec. 7-6. Building permit fee schedule.
(a) Any person, firm or corporation applying to the City of Baytown
for a building permit shall pay to the city,. prior to the issuance of
said permit,. a building permit fee. as follows:
• (1) Permit fees for any building used for business or
commercial purposes shall be based on the schedule contained in
Section 107.4 and Appendix "K" of the Standard Building Code.
(2) Permit fees for residential buildings shall be based on the
following schedule:
Improvements Costing : Fee :
A. $1 . 00 •to $1.,000. 00 $10. 00
B. Per each additional improvement
costing $1 ,000 . 00 $2 . 00
(b) No building permit shall issue for the construction or repair of any
structure within the 100 year floodplain which permit does not require •
the entire structure to meet the standards established by this Code of
Ordinances. --
(c) The calculation of the improvement cost shall be made upon the
basis of the fair market value of the required materials, service and
labor, performed in a workman like manner.
Section 2: All ordinances or parts of ordinances inconsistent with the terms
. of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 3: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.

Section 4: This ordinance shall take effect immediately from and after its
. passage by the City Council of the City of Baytown.
