WHEREAS, the City of Baytown, Texas, owns certain property, a portion of
.which is needed for an underground electrical utility easement to serve wells located
an`:City property; and
WHEREAS, the well owner has offered to purchase said easement
for its appraised value; and
WHEREAS, the use of electrical motors on these wells will cause less noise
within adjoining neighborhoods than gasoline or diesel gerwr ato. —, and
WHEREAS, the Tax Department of the City of Baytown has determined the
value of such easement described in Exhibit "A" to be TWO HUNDRED
SEVENTY -FIVE AND NO /100 ($275.00) DOLLARS and the value of such easement
described in Exhibit 'B" to be EIGHT HUNDRED AND NO /100 ($800.00) DOLLARS;
and
WHEREAS, Article 5421c V.T.C.S. provides that the City may sell easements
of land for market value without the necessity of taking bids, and
WHEREAS, the City Council of the City of Baytown finds and determines
that the fair market value of the property described in Exhibit "A" is TWO
HUNDRED SEVENTY -FIVE AND NO /100 ($275.00) DOLLARS, and the value of such
easement described in Exhibit "B" is EIGHT HUNDRED AND NO /100 ($800.00)
DOLLARS, and is of the opinion that same should be sold for that sum; NOW
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: The sale of the property described in Exhibit "A" and "B" to
Minex, Inc. is hereby authorized, and the Mayor and City Clerk are authorized and
directed to execute such instruments, if any, necessary for such conveyance.
Section 2: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.

10 FOOT WIDE UTILITY EASEMENT
Being the centerline of a 10 foot wide utility easement, 5 foot wide on
r either side of said centerline, out of an 11.8943 acre tract of land out
of the William Scott Upper League, Abstract No. 66, Harris County, Texas,
conveyed to the City of Baytown per instrument recorded in Vol. 5334,
Page 68, of the Deed Records of Harris County, Texas, said centerline
more particularly described by metes and bounds as follows:
COMMENCING at a h inch iron rod found at the intersection of the north-
westerly line of said 11.8943 acre tract with the northeasterly line of
Arizona Street, based on a width of 50.00 feet;
THENCE North 24 deg. 04 min. 02 sec. East, along said northwesterly line,
a distance of 46.51 feet to the PLACE OF BEGINNING of the herein de-
scribed centerline;
THENCE South 66 deg. 38 min. 09 sec. East, a distance of 107.88 feet, to
the terminus point of the herein described easement.

Being the centerline of a 10 foot wide utility easement, 5 foot wide
on either side of said centerline, out of a 31.727 acre tract of land 1
out of the William Scott Upper League Abstract, No. 66, Harris County,
Texas, conveyed to the City of Raytown per instrument recorded in
Volume 5334, Page 73, of the Deed Records of Harris County, Texas,
said centerline being more particularly described as follc ,:
COMMENCING at a concrete monument found in the south right -of -way line 3
of State Highway 146, based on a variable width, and marking the °point
of beginning" of the said 31.727 acre tract;
THENCE South 89 deg. 54 min. 00 sec. East, a distance of 47.47 feet to
the PLACE OF BEGINNING of the herein described centerline;
THENCE South 28 deg. 46 min. 17 sec. East, a distance of 46.52 feet to
a point on said centerline;
THENCE South 36 deg. 13 min. 21 sec. East, a distance of 48.86 feet to
a point on said centerline;
