BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the Code of Ordinances, City of Baytown, Texas, is hereby
amended by adding a section, to be numbered Sea 14 -1(d), which said section reads
as follows:
Sec. 14-1. Defirdtions.
(d) Approved residential waste container: By the term "approved
residential waste container" is meant plastic or paper bags. Plastic
bags shall have a minimum thickness of 1.5 mil and a capacity of not less than ten (10) nor more then thirty (30) gallons. Such bags shall be
tightly closed by cord, wire or rubber band, in such manner as to
prevent leakage of contents. Paper bags may be used under the same
_ terms and conditions as plastic bags, provided such bags have a wet
strength of at least fifty (50) pounds
Section 2: That Section 14 -4 of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:
Sec. 14-4. Disposal of garbage.
All garbage shall be disposed of in approved residential waste
containers i.e. plastic or paper bags Garbage placed in any type of
container other than an approved residential waste container shall not
be collected.
Section 3: That Section 14 -10 of the Code of Ordinances, City of Baytown,
Texas, is hereby amended to read as follows:
Sec. 14-10. Time of collectiom
Garbage, trash or brush will be placed within the street right -of -way by
7:30 a.m. on the day of collection.
Section 4: That Section 14 -15 of the Code of Ordinances, City of Baytown,
Texas, is hereby repealed.

Section S: All ordinances or parts of ordinances inconsistent veith the sterns
of this ordinance are hereby repealed, provided however, that such repeal shall be

only to the extent of such inconsistency and in all other respects this ordi -,anee

shall be cumulative of other ordinances regulating and governing the subject mattes
covered by this ordinance.
Section 6: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of some to any
person or set of circumstances, shall for any reason be held unconstitutional, void or

invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to

this end all provisions of this ordinance are declared to be severable.

Section 7: This ordinance shall take effect November 1, 1984.
