13E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOW4,
TEXAS:
Section 1: That the prima facie maximum speed limit with respect to
Decker Drive, between Wade Road and Rollingbrook Drive, is established at 45 miles
per hour; and the City Council hereby determines and declares this prima facie
speed limit to be reasonable and prudent.
Section 2: The Director of Planning and Traffic is authorized and directed to
cause the proper signs to be posted at the above described location.
Section 3: It shall be unlawful for a driver of a vehicle to disobey the
instructions of the signs placed in accordance with the provisions of this ordinance,
unless at the time otherwise directed by a police officer or traffic control signal.
Section 4: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 5: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shalt for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 6: Any person who shall violate any provision of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a
fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred
