ORDINANCE NO. 3910
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, ESTABUS 04G A PRIMA FACIE Spy LIMIT OF
35 MILES PER HOUR FOR MOTOR VEHICLES ON A PORTION OF
NORTH MAIN STREET BETWEEN MORRELL STREETICEDAR BAYOU
ROAD AND BOB SMITH ROAD; ESTABLISHING A PRIMA FACIE
SPEED LIMIT OF 45 MILES PER HOUR FOR MOTCq VEHICLES ON q
PORTION OF NORTH MAIN STREET 13ETWEEN BAKER ROAD AN D
LYNCHBURG CEDAR BAYOU ROAD; REPEALING OR O ANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE;
PRESCRIBING A MAXIMUM PENALTY OF TWO HARED AN NQ/ 00
(S200.00) DOLLARS FOR EACH VIOLATION THEREOF; AND
PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYToNgs
TEXAS:
Section U That the prima facie maximum speed limit with respect to North
Main Street, between Morrell Street /Cedar Bayou Road and Bob Smith Road is
established at 35 miles per hour; and the City Council hereby determines and
declares this prima facie speed limit to be reasonable and prudent.
Section 2: That the prima facie maximum speed limit with respect to North
Main Street, between Baker Road and Lynchburg Ceoar Bayou Road, is established
at 45 miles per hour; and the City Council hereby determines and declares this
Prima facie speed limit to be reasonable and prudent.
Section 3: The Director of Planning and Traffic is authorized and directed to
cause the proper signs to be posted at the above described location.
Section 4: It shall be unlawful for a driver of a vehicle to disobey the
instructions of the signs placed in accordance with the provisions of this ordinance,
unless at the time otherwise directed by a police officer or traffic control signal.
Section 5: All ordinances or parts of ordinances inconsi :tent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.

Section 6: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or

Section 7e Any person who small violate any provision of this ordinance

its passage by the City Council. The City Clerk is hereby directed to give notice
hereof by causing the caption of this ordinance to be published in the official
newspaper of the City of Baytown at least twice within ten (10) days after the
passage of this ordinance.
