COMPANY FOR THE RELOCATION OF A WATER AND SEWER MAIN

DRAINAGE (DITCH PROJECT; AND PRO11IDM FOR THE EFFECTIVE

WHEREAS, the City of Baytown entered into an Interlocal Agreement with
Harris County Flood Control District for the construction of the Bayway
Drive /Baker Road Drainage District Project; and
WHEREAS, during the course of such construction, it was necessary for the
Harris County Flood Control Districc's contractor, Baytex Construction Company, to
relocate a water and sewer main belonging to the City of Baytowrr, and
WHEREAS, all of the said improvements been performed and completed in
full accordance with all of the terms and conditions of the aforesaid agreement end
WHEREAS, The City Engineer in the manner provided by the terms of the
said Interlocal Agreement has approved and accepted the work and improvements
and has certified some to the City Council and recommended that it accept and
receive said work and improvements as constructed and completed by Bayte--
Construction Company; and
WHEREAS, there remains due and owing to the said contractor the sum of
THIRTY FIVE THOUSAND THREE HUNDRED AND NO /100 ($35,300.00) DOLLARS,
NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council hereby accepts and approves the above
described work and improvements, and finds and determines that all of said
improvements have been completed as provided in the plans and specifications
therefor, and in full accordance with all of the terms and provisions . of the
aforesaid contract.
Section 2: That the acceptance and certification by the City Engineer is
hereby accepted and received.
Section 3: That payment to the said contractor in the amount of
THIRTY FIVE THOUSAND THREE HUNDRED AND NO /100 ($35,300.00) DOLLARS,
is hereby authorized and directed.
Section 4: This ordinance shall take effect from and after its passage.
