Ordinance No. 3,901:7 n v x a Published: The Baytown Sun 40712`3 Tuesday, July 17 1984 Wednesday, July 18, 1984 ORDINANCE NO. 3901 AN ORDINANCE OF THE CITY CODUNCIL OF THE CITY OF BAYTOWN AUTHORIZING THE INSTALLATM N OF TRAFFIC - CONTROL sm24AL.S ON LOOP 201 AT STATE HIGHWAY 146 (EAST I NTERSECTIC" AND LOOP 201 AT STATE HIGHWAY 146 (WEST INTERSECTION); PROVIDING FOR THE APPROVAL OF AN AGREEMENT BETWEEN THE STATE OF TEXAS AND THE CITY OF BAN TOWN FOR THE INSTALLATION, CONSTRUCTION, EXISTENCE, USE, OPERATK)N, AND OF H K3HWAY SK24AL PROJECTS AT THAT LOCATION IN THE CITY OF BAYTOWN; PROVIDING FOR THE EXECuTIC N OF SAID AGREEMENT; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO H LI NDRED AND NO 1100 (3200.00) DOLLARS; AND PROVIDING FOR THE PIELICATION AND EFFECTIVE DATE HEREOF. WHEREAS, Texas Revised Civil Statutes article 6701d provides that local authorities in their respective jurisdiction may place and maintain any traffic - control device upon any highway under their jurisdiction es they may deem necessary, taking into consideration the usual traffic flow of the streets or highways within their jurisdiction. Ssid governing body may determine that various local traffic-control devices are necessary and shall direct said appropriate devices be erected by the passage of an ordinance, which shall be effective when appr^priate traffic-control devices giving notice thereof are erected at such intersection or other place or part of the street or highway, and WHEREAS, article 6701d further provides that no local authority shall erect or maintain any traffic - control device at any location so as to require the traffic on any State highway, including Farm-to-Market or Ranch -to- Market roads, to stop or yield before entering or crossing any intersecting highway unless such device is erected and maintained by virtue of an agreement entered into between such local authority and the State Department of Highways and Public Transportation, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, ® TEXAS: Section .1: That on the basis of an engineering and traffic study heretofore made as authorized by the provisions of Texas Revised Civil Statutes article 6701d, traffic - control signals, are authorized to be placed on Loop 201 at State Highway 146 (East Intersection) and Loop 201 at State Highway 146 (West Intersection). CJ r 1 L J v 4071Z %m R, rS u Section 2: That an agreement between the State of Texas arid the City of } Baytown, for the installation, construction, existence, use, operation, and maintenance of certain highway traffic-control devices at the intersection of loop 201 at State Highway 146 (East Intersection) and Loop 201 at State Highway 146 (West Intersection) in the City of Baytown, attached hereto as Exhibit "A," be and the same is hereby approved, and the Mayor of the City of Baytown is hereby authorized to execute said agreement on behalf of the City of Baytown, and - transmit the same to the State of Texas for appropriate action. Section 3: The Director of Planning and Traffic is hereby authorized to cause the traffic - control devices to be installed. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. �t Section 6: It snail be unlawful for a driver of a vehicle to disobey the instructions of the ottieial traffic - control devices placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer or traffic- cor'rol signal. Section 7: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a • fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred and NO /100 ($200.00) Dollars except minors who have passed their 14th birthday but have not 'reached their 17th birthday shall be punished by a fine of not more than One Hundred and NO /100 ($100.00) Dollars. l- 407:2 =•3b ® Section S: This Ordinance shall take effect from and after ten (10) bays from r..._:; its passage by the City Council. W I T N E S S E T H WHEREAS, the City has authorized the Installatioa of highvsy traffic signals) by Ordinance /2xwa xis passed on the day of __ ► 19 _. at the location(s) shown on EXHIBIT 1, attached hereto and made .a Part hereof; AGREEMENT NOW, THEREFORE, in consideration of the premises and of the Mutual covenants and agreements of the parties hereto to be by them respectively kept and performed, as hereinafter set forth, it is agreed as follows: 1. The State will furnish the necessary funds for the actual construction, prepare plans and specifications, install said highway traffic signal(s), and supervise construction. 2. The City hereby consents to the construction of the highway traffic signal(s) shown on EXHIBIT 1 by the approval of the location and manner of construction as shown on the plans and described in the specifications. 3. The City will operate and maintain the highway traffic signal(s) at City's expense upon completion of the installation(s) by the State. 4. The City trill pay all power costs for operating the signal(s). _ AGREEMENT (TRAFFIC SIGNAL - TYPE E -1A) I„q 2 -82 n U tom, 40712- 3d S. The City will, obtain written aproval of the State Department of Highways and Public Transportation before making any changes in the design of operation and timing of the signal(s) or before removing any part of the installation(s). 6. The City will return any and all parts of said highway traffic signal installations) to the State should it (they) be removed by the City for any reason other than for installation on a State or Federal numbered highway route at a location approved by the State. 7. The City will be. responsible for the police enforcement required for securing obedience to the highway traffic signal(s). S. In the event the signal(s) installed in accordancee with this Agreement become unnecessary or are removed for any reason this Agreement shall terminate. 9. Indemnification r The City agrees to indemnify the State against any and all damages and claims for damages to adjoining, abutting or other property for which the State is or may be liable arising out of, incident to or in any way connected with the Installation, the construction, the existence, the use of such..project and does hereby agree to indemnify the State against any and all court costs, attorneys' fees and all expenses in connection with suits for such damage and shall, if requested to do so in writing, assist or relieve the State from defending any such suits brought against it. Nothing in this agreement shall be construed to place any liability on the City for personal injury arising out of the construction of such project. Furthermore, it Is not the intent of this agreement to impose upon the City the liability for injury to person or property arising out of the construction of the project by the State's contractor unless the State itself would be liable for such injury or damage. AGREEMENT (TRAFFIC SIGNAL - TYPE E- W 2 -82 2-4 r: FM d07123e Nothing herein contained shall be construed to place upon the State any manner of liability for injury to or death of persons or for damage to or loss of property arising out of or in any manner connected with the use of the project, and the City will save the State harmless from any damages arising from said mIrx- tenance and /or use of said project. It is further understood and agreed between the parties hereto, that the improvement of the project by the State is for the sole purpose of providing the travelling public a more adequate travel facility and shall never be the basis of any claim for State assumption, or participation in the payment, of a:.y of the obligations of the City incurred in the improvement, past or present, of any street project. t0.
