Ordinance No. 3,873v n ORDINANCE NO. 3873 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, PROVIDING THAT A PORTION OF AN UTILITY EASEMENT BE VACATED, ABANDONED AND CLOSED; PROVll384G FOR THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF + t.* s�rart� +tstttt.. *s.a��ttt #�r #..�tftt• scarf. �t tsts. r+ r +��.r :.f..ES ;s�ar� *.xs+r..ww,r WHEREAS, there is a certain dedicated utility easement which runs on Lot 10 of Block 3, Section 1 of the Decker Terrace Subdivision; and WHEREAS, U. S. Homes is the affected land owner and has made application that this easement be discontinued, closed and abandoned as a dedicated utility easement; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, Section 1: The property to be abandoned is described as follows: BEGINNING at the southeast corner of Lot 10, Block 3, Section 1 of Decker Terrace Subdivision of the City of Baytown, Harris County, Texas, as the POINT OF BEGINNING; THENCE, 100.63 feet in a northerly direction along the east property line of the above described lot to a point 10 feet south of the north property line of said lot; THENCE, 5 feet in a westerly direction perpendicular to and 10 feet south of the north property line of said lot; THENCE 100.63 feet in a southerly direction perpendicular to and 5 feet west of the eastern most property line of said lot to a point in the south property line of said lot; THENCE, 5 feet in an easterly direction along the south property line of said lot to the POINT OF. BEGINNING, being a tract of approximately 503.16 square feet, more or less. Section 2: That the portion of the dedicated utility easement described above is hereby closed, abandoned and permanently vacated as a dedicated. Section 3: That the interest or interests of the City and /or the public in the above described portion of said easement (and as shown in Exhibit "A" attached hereto) is hereby quitclaimed to the adjacent owner for and in consideration of THREE HUNDRED AND NO /100 ($300.00) DOLLARS Section 4: That the Mayor and City Clerk are hereby authorized to execute such instruments, if any, necessary for such abandonment and sale. Section 5: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
