Ordinance No. 3,859• ORDINANCE NO. 3859 ..,J nRDINANICE F—MiMG THE CONTRACT FOR (QTY DEVELOPWNT REHABILITATION PROJECT 083 -03-17 TO PROSPER OR07HERS CONSTRUCrg0NI FOR THE SUM OF SEVEN THOUSAND SEVEN HUNDRED TWENTY SIX AND NO1100 ($7,726.00) DOLLARS. r## t# rrr# r# t# rrr+ tatrrt +trrrttrtrr #t #rrrttttrarar #attar #rrrrrFtr :rrrttrrr #rats # # #rrt WHEREAS, the City of Baytown's Community Development Program did advertise for bids for Community Development Program Rehabilitation Project 083 -03 -17 to be received May 8, 1984; and WHEREAS, notice to all bidders as to the time and place, when and where the contract would be let was published pursuant to provisiom of Section 74 of the Charter of the City of Baytown, and WHEREAS, all bids were opened and publicly read at the Community Development Office at 10:00 a.m., as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Prosper Brothers Construction for the am of SEVEN THOUSAND SEVEN HUNDRED TWENTY SIX AND NO 1100 ($7,726.90) DOLLARS for Community Development Rehabilitation Project 083 -03-17 being the repair and rehabilitation of 1317 Willow, providing that no money will be paid to said Contractor until completion and acceptance of the work by the Owner and the Baytown Community Development Program. Section 2: That pursuant to the provisions of TEX. REV. CIV. STAT. art 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Five Thousand and No /100 ($5,000.00) Dollars or less, provided that the original contract price may not be increased by more than ten (10%) percent or decreased by more than twenty -five (25%) percent without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect from and after its passage.
