WHEREAS, due to unforeseen
damage to the air conditioner at the Fire
Administration Building, said unit is presently not operable; and
WHEREAS, air conditioning is necessary for the proper operation of the Fire
Department radio equipment; and
WHEREAS, TEX. REV. CIV. STAT., article 2368a provides that in case of
unforeseen damage to
public property, machinery or equipment, the requirement for
competitive bids is not appiicablq and
" WHEREAS, the administration has taken informal bids for the necessary repair
work; NOW 7H REFORE
f. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY Of BAYTOWN,
TEXASe
II' Section 1: That the City Council hereby declares that due to unforeseen
is
damages to the air conditioning unit at the Fire Administration Building, an
emergency exists.
Section 2: That the City Council of the City of Baytown y wn hereby accept the
bid of Ainsworth and Company for the replacement of the air conditioning unit at
the Fire Department for the sum of NINE THOUSAND TWO HUNDRED FORTY
FOUR AND NO /10 ($4,244.00) DOLLARS, and authorizes payment thereof..
Section 3: This ordinance shall take effect immediately from and after its
Passage by the City Council of the City of Baytown.
