BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOwN,
TEXASc
Section 1: That the Code of Ordinances of the City of Baytown is amended
by the amendment of Chapter 15, "Health and Sanitation," by the addition of a new
Section 15 -7, which shall read as follows:
CHAPTER 15, HEALTH AND SANITATION
ARTICLE L W GENERAL
Sec. 15-7. Leaving infants unattended in motor vehicles prohEbited.
(a) A person commits an offense if he intentionally or
knowlingly leaves an infant under seven (7)
years of age
unattended in a motor vehicle for more than five (5)

minutes.
(b) It shall be presumed that such infant is unattended if no
older person is present.
(c) It shall be presumed that such infant has been left for more
than five (5) minutes if
such child is exhibiting obvious physical
distress.
(d) An offense under this section shall be punished by fine not
to exceed ONE THOUSAND AND N0/100 ($1,000.00) DOLLARS.
Section 2: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shell be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 3: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same
to any
person or set of circumstances, shall for any reason be held
unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions
of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
