BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOw4, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is amended by the amendment of Chapter 27, "Subdivisions," by the addition of a new Subsection 27- 34(e), which shall read as follows: Sec. 27 -34(e) Off - Street Parking Requirements. (1) The Planning ,Commission shall be responsible for off- street parking requirements for developments that must be platted. (2) The Planning Commission may grant an exception to the requirements of Chapter 19 1/2 "Off - Street Parking," when in their opinion one or more of the following apply to the platted development: (a) the exception is not inconsistent with the intent of the ordinance. (b) the development of additional phases will include provisions for any shortage. (c) the proposed development is shown to not fit existing categories. (d) the proposed structures include areas that win not be used as a part of the majority use proposed. Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governirWthe subject matter covered by this ordinance. Section 3: If any provision, section, exception, sut• section, paragraph, ® sentence, clause or phrase of this ordinance or the application of same to any person or set'rcumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are dsclared to be severable.
