ORDINANCE NO. 3805
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AMENDING CHAPTER 16 112, - MECHANICAL
CODE," BY THE DELETION OF REQUIREMENTS PERTAINING TO
JOURNEYMEN AND APPRENTICES; CHMGM THE REGOW- ETITS
FOR AN AIR CONDITIONING CONTRACTOR'S LICENSE TO CokVLY
WITH STATE LAW; REPEALING ORDINANCES INCONSISTENT
HEREWITH; CONTAINBNG A SAVINGS CLAUSE; AND PROVIDING FOR
THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
Section 1: That Subsection 16 1/2 -3(c) of the Code of Ordinances, City of
iytown, Texas, is hereby amended to read as follows:
16 1/2 -3. Mechanical board - Powers and Duties
`. (c) The Board shall have the power to examine and license air
conditioning contractors and shall determine the fitness and
qualifications of all persons applying for such license pursuant to
this chapter.
Section 2: That Section 16 1/2 -11 of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows
Sec. 16 1/2 - 11. License categories.
These shall be only one type of license issued by the City of
Baytown: Air Conditioning Contractor. An "air conditioning
contractor" within the meaning of this Code is a person having a
regular place of business, who, by himself, or through person or
persons In his employ, performs installation of mechanical
systems, within the scope of Section 101.3 of the Standard
Mechanical Code.
Section 3: That Subsection 16 1/2 =12(b) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows
Sec. 16 1/2 -12. Application.
b. Prerequisites. An applicant for an air c onditioning
contractor's license must be 18 years old and have at least three
years of practical experience in air conditioning work. For the
purpose of the experience requirement, a degree or diploma in air
conditiogning engineering or mechanical engineering from an
ins%itut'Pon of higher education whose program is approved by the
Texas State Board of Registration for Professional Engineers for
the purpose of licensing professional engineers is considered the
equivalent of two years practical experience. The application
must be verified by the Mechanical Board.

Section 4: That Section 16 112 -13 of the Code of Ordinances, City of
Baytown, Texas, is hereby amended by the repeal of Subsection W.
Section 5: That Section 16 1/2 -14 of the Code 3f Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:
Sec. 16 1/2- 14. Fees.
(a) Application fees. The payment of an application fee of ten
dollars ($10.00) is required for air conditioning contractors at the
time the application is filed with the board, and a ten dollar
($10.00) application fee is required for each reexamination.
(b) License fees. The initial fee for an air conditioning
contractor's license shall be fifty dollars ($50.00) for the first
year and the renewal fee shall be twenty -five dollars ($25.00).
Section 6: That Subsection 16 1/2 -15(b) of the Code of Ordinances, City of
Baytown, Texas, is hereby amended to read as follows:
Sec. 16 1/2 -15. Renewal.
(b) Air conditioning contractors may renew an expired license
® upon payment of back fees and a twenty -five dollar ($25.00)
penalty. No license that shall have elapsed for as much as two
(2) years, however, shall be renewed except upon reexamination,
the payment of the initial fee, and upon the some terms and
conditions as provided in the case of original examination.
Section 7: That Section 16 1/2 -21 of the Code of Ordinances, City of
Baytown, Texas is hereby repealed.
Section 8: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 9: If any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 10: This ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
