AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO MW

W,WREAS, the City Council of the City of Baytown now finds
and determines that public convenience and necessity require that
the City of Baytown acquire the tract described below; NOME
THEREFORE,
BE IT ORDAINED BY THE CITY CMJNCI L OF THE CITY OF BAV TOM,
TEXAS
Section 1s That the City Attorney is hereby authorized and
directed to make the offer Tested below to the below named owner,
or other parties in interest believed to be the true owners of
said property or to the actual real and true owners thereof,
whether correctly named or not, for the purchase and acquisition
by the City of Baytown of the fee interest in the said tract
that is required for park purposes within the City of Baytown:
An one -half undivided interest in 10.3 acres
of the H. F. Gillette Survey, A -297, Harris
County, Texas, shown as Tract 4 on City of
Baytown Tax Map.

Section 2. Such offer shall provide the t if the offer
should not be accepted within fifteen (15) days after receipt,
the City of Baytown will consider such offers refused and will
institute condemnation proceedings on behalf of the City of
Baytown under any applicable provisions of the law, whether
provided by Title 52 of the ReviseJ Civil Statutes, Chapter l7 of
Title 28 of said Statutes, the Charter of the City of Baytown, or

any other provisions.
Section 3s Should such offer be accepted, the money above
set forth shall be paid out of any appropriation heretofore made
for the public purpcse for which the above described tracts are
required. Should such offer not be accepted, the amount finally
awarder; to the owner in the condemnation proceeding, plus costs,
fees, and expenses, shall be paid out of such funds so appro-
priated.
Section 4: All ordinances or parts of ordinances incon-
sistent with the terms of this ordinance are hereby repealed,
provided however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall
be cumulative of other ordinances regulating and governing the
subject matter covered by this ordinance.
Section 5: This ordinance shall take effect irrnediately
from and after its passage by the City Council of the City of
Baytown.
INTROCUCED, READ, and PASSED by the affirmative vote of the
City Council of the City of Baytown on this the 12th day of
January, 1984.
