AN ORDINANCE AWARDM THE CONTRACT FOR COMMriTY
DEVELOPMENT REHABILITATION PROJECT 083 -03 -04 TO
PROSPER BROTHERS COMSTRLICTION FOR THE SLRA OF EIGHT
THOUSAND AND NO /100 ($9A00M DOLLARS.

WHEREAS, the City of Baytown's Community Development Program did
advertise for bids for Community Development Program Rehabilitation Project
083 -03 -04 to be received October 4,1983; and
WHEREAS, notice to all bidders as to the time and place, when and where
the contract would be let was published pursuant to provisions of Section 74 of the
Charter of the City of Baytown, and
WHEREAS, all bids were opened and publicly read at the Community
Development Office at 10:00 a.m., as per published notice to bidders; NDw
THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAyTOVR4,
TEXASi
Section l: That the City Council of the City of Baytown hereby accepts the
bid of Prosper Brothers Construction for the sum of EIGHT THOUSAND AND
NO /100 ($8,000.00) DOLLARS for Community Development Rehabilitation Project
083 -04-05 being the repair and rehabilitation of 817 Yupon, providing that no money
will be paid to said Contractor until completion and acceptance of the work by the
Owner end the Baytown Community Development Program.
Section 2: That pursuant to the provisions of TEX. REV. CiV. STAT. art
2368e, the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of Five Thousand and No /100
($5A00.00) Dollars or lass, provided that the original contract price may not be
increased by more then ten (10 %) percent or decreased by more than twenty -five
(25 %) percent without the consent of the contractor to such decrease.
Section 3: This Ordinance shall take effect from and after its passage.

Council of the City of Baytown on this the 27th day of October, 1983.
