Section It That the Code of Ordinances of the City of Baytown is hereby
amended by the amendment of Chapter 25 1/2, "Standard Sign Code ", Subsection 25
1/2 - 5(9)3, which shall read as follows:

Sec. 25 1/2 - 5( g) Existi ng signs; operating permits:
(3) When any sign is blown or knocked down, or a substantial part of
a sign is destroyed, damaged, or taken down or removed for any
purpose other than maintenance operations or for charging the letters,
symbols, or other matter on such sign, it shall not be re- grected,
reconstructed, or rebuilt, except in full conformance with this Chapter.
Substantial part of a sign shall mean at least 50% of the above ground
structure of the sign, with said 50% to be based on the square foot
area of the sign and support structure, as opposed to any monetary
value or repair cost.
Blown or knocked down shall mean and include when the head is blown
off a sign, when the sign collapses or telescopes on itself, or when the
sign leans more than 15 degrees from the vertical, and is the result of
wind action or any other force that may blow against or strike the
sign.
Section 2: All ordinances or parts of ordinances inconsistent with the terms
of this ordinance are hereby repealed, provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
• Section 3: if any provision, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this and all provisions of this ordinance are declared to be severable.
Section 4: This Ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.
