ORDINANCE NO. 3691
AN ORDINANCE AWARDING THE CONTRACT FOR COMMUNITY
DEVELOPMENT REHABILITATION PROJECT x#83 -04 -03 TO
PROSPER BROTHERS CONSTRUCTION FOR THE SUM NINE
THOUSAND SEVEN HUNDRED NINETY AND NO /100 ($9,790.00)
DOLLARS.
WHEREAS, the City of Baytown's Community Development Program did
advertise for bids for Community Development Program Rehabilitation Project
#83 -04 -03 to be received August 18, 1983; and
WHEREAS, notice to all bidders as to the time and place, when and where
the contract would be let was published pursuant to provisions of Section 74 of the
Charter of the City of Baytown, and
WHEREAS all bids were opened and publicly read at the Community Develop-
ment Office at 10:00 a.m., as per published notice to bidders; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown hereby accepts the
bid of Prosper Brothers Construction for the sum of NINE THOUSAND SEVEN
HUNDRED NINETY AND NO/100 ($9,790.00) DOLLARS for Community Development
Rehabilitation Project #83 -04 -03 being the repair and rehabilitation of 1020 Dailey
Street, providing that no money will be paid to said Contractor until completion and
acceptance of the work by the Owner and the Baytown Community Development
Program.
Section 2: That pursuant to the provisions of TEX. REV. CIV. STAT. art
2368a, the City Manager is hereby granted general authority to approve any change
order involving a decrease or an increase in costs of Five Thousand and No /100
($5,000.00) Dollars or less, provided that the original contract price may not be
increased by more than ten (10 %) percent or decreased by more than twenty -five
(25 %) percent without the consent of the contractor to such decrease.
Section 3: This Ordinance shall take effect from and after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown on this the 22nd day of September, 1983.
