Ordinance No. 3,680PUBLISHED IN: The Baytown Sun 30922 -2 Tuesday, Sept. 27, 1983 Wednesday, Sept. 28, 1983 ORDINANCE NO. 3680 AN ORDINANCE AMENDING CHAPTER 31, °UTILITIES," OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN BY AMENDING SUBSECTION 31- 65(A), RATE SCHEDULE FOR SEWER SERVICE CHARGE; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. ##- it##-/ r#####- 1FtiF#* fEK- iE# kyFfE## i{- �Ek�iEiF## iF�E## �F# tiF**- k##;{- iEiE## iFkiFiE # #3F # # #ifril- # #iF1FiFiFif-iFiE it ifiE # #iE # # ## BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the Code of Ordinances of the City of Baytown is hereby amended by the amendment of Chapter 31, "Utilities," Article V, Sewer Service, by the repeal of Subsection 31- 65(A), Rate Schedule for Sewer Service Charge, as presently constituted, and by the addition of a new Subsection 31 -65(A) which shall read as follows: Sec. 31 -65. Sewer service charge. A. Rate Schedule 1. Minimum monthly rate .. ............................... $5.00 2. Standard rate (per 1,000 gallons in excess of minimum monthly ) .........................$1.00 Section 2: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. Section 3: if any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section 4: This ordinance shall become effective with billings showing service for the month of October, 1983. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance. 30922 -2a INTRODUCED, READ, and PASSED by the affirmative vote of the City Council of the City of Baytown, this the 22nd day of September, 1983.
