Ordinance No. 3,669PUBLISHED IN: The Baytown Sun 30825 -1 Monday, Aug. 29, 1983 Tuesday, Aug. 30, 1983 ORDINANCE NO. 3669 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN DECLARING THE BROWNWOOD AREA A HEALTH AND SAFETY HAZARD; SUSPENDING THE ISSUANCE OF BUILDING PERMITS WITHIN THE BROWNWOOD AREA; PROHIBITING THE OCCUPANCY OF STRUCTURES WITHIN BROWNWOOD; CONTAINING A PENALTY CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. #- k# iE* iF#* iF####- il-#### iF# if** iF##*##### kifroEiF#*** k# �FrF± F## �-# kiFdFil#* yEit* 1r- it- iF# iE #+F3F #iFiEk #k *iEtif-- iF #iE * # ## WHEREAS, Hurricane Alicia has caused substantial damage within the City of Baytown, with the Brownwood area being one of the most damaged areas; and WHEREAS, many homes were completely swept away, and all houses in the lower areas of Brownwood suffered substantial damage; and WHEREAS, electrical service to the area was destroyed, and cannot be safely restored due to the many downed power lines; and WHEREAS, due to the many broken water and sewer lines, and due to other damage to City facilities, water and sewer service cannot be provided in the area; and WHEREAS, raw sewage is evident in many areas of the Brownwood area; and WHEREAS, the above described conditions make the Brownwood area a health and safety hazard, and unfit for human occupation; and WHEREAS, the City Health Officer has declared the Brownwood area a health hazard and unfit for human occupation; and WHEREAS, due to the hazardous nature of the Brownwood area, City Council has determined it is necessary to prohibit the rebuilding and /or occupation of the Brownwood area until the hazard conditions can be rectified; and WHEREAS, the hazard area is shown on the attached map, which is marked Exhibit "A" and made a part hereof for all intents and purposes; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Administration is to suspend building permits for the erection or repair of any building in the Brownwood hazard area for a period of 14 days. Section 2: That the occupancy of any structure within the Brownwood hazard area is prohibited and is declared unlawful for a period of 14 days. 30825 -1a Section 3: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Two Hundred and No /100 ($200.00) Dollars. Section 4: This Ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown, except for the penalty provision, which shall take effect from and after ten (10) days from its passage by City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after passage of this ordinance.
