ORDINANCE NO. 3659
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN APPROVING AN EXCHANGE OF PROPERTY WITH DETER
CHAPEL CHURCH OF GOD IN CHRIST; AUTHORIZING THE
EXECUTION OF THE NECESSARY INSTRUMENTS FOR SUCH
EXCHANGE; PROVIDING FOR CERTAIN CONDITIONS; AND
PROVIDING FOR THE EFFECTIVE DATE HEREOF.
WHEREAS, the Central Heights Parks is separated by a narrow strip of land
from the recently acquired park property north of Central Heights Park; and
WHEREAS, this narrow strip is used by Jeter Chapel Church of God in Christ
for its utility service, including overhead power lines; and
WHEREAS, Jeter Chapel Church of God in Christ is willing to swap this
narrow strip of land for a ten foot utility easement across the southernmost part of
Central Heights Park; and
WHEREAS, this swap would allow the City to use the new property as an
extension of Central Heights Park; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City of Baytown hereby agrees to exchange with Jeter
Chapel Church of God in Christ an utility easement across property owned by the
City as described in the attached Exhibit "A" for the sixteen foot strip of land
owned by Jeter Chapel Church of God in Christ as described in Exhibit "B ".
Section 2: That Jeter Chapel Church of God in Christ will also continue to
have an underground utility easement beneath the property described in Exhibit "B ".
Section 3: That the exchange is being made with the understanding, and is
conditioned upon the City of Baytown not being responsible in any manner for the
cost of relocating the utility service lines of Jeter Chapel Church of God in Christ
to the easement described in Exhibit "A ".
Section 4: The Mayor and the City Clerk are hereby authorized and directed
to execute and attest to such instruments that may be necessary to complete the
exchange of property.
Section 5: This Ordinance shall take effect immediately from and after its
passage by the City Council of the City of Baytown.

CENTRAL HEIGHTS PARK
BEING a tract or parcel of land containing 0.048 acres in the William
Scott (Upper League) Survey, Abstract No. 66, and lying wholly within
that certain 1.0 acre tract as conveyed to the City of Baytown and
recorded on Film Code No. 154 -27 -0740 on December 8, 1972 of the Harris
County Deed Records, said 0.048 acre tract being a 10.0 foot wide and
20.0 foot aerial easement and which is more particularly described by
metes and bounds as follows:
BEGINNING at a 5/8 inch diameter iron rod, said iron rod being at the
Northeast corner of the aforementioned 1.0 acre tract; said point being
in the North boundary line of Atlantic Street;
THENCE, South 33° 00' 00" West along the West boundary line of Atlantic
Street for a distance of 200.0 feet to the Point of Beginning;
THENCE, South 33° 00' 00" West along the West boundary line of Atlantic
Street for a distance of 10.0 feet to a point for a corner, said point
being the Southeast corner of the aforementioned 1.0 acre tract;
THENCE, North 57° 00` 00" West along the South property line of the 1.0
acre tract for a distance of 207.43 feet to a point for a corner, said
point being the Southwest corner of the 1.0 acre tract;
THENCE, North 33° 00' 00" East along the West property line of the 1.0
