Ordinance No. 3,65230714 -1 ORDINANCE NO. 3652 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, PROVIDING THAT A PORTION OF AN OVERHEAD UTILITY EASEMENT BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE QUITCLAIMING OF THE CITY'S INTEREST IN SAID PROPERTY; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, There is a certain dedicated overhead utility easement which runs between Savell Drive and the Harris County Flood Control Easement in Section 1 of the Whispering Pines Subdivision according to the replat records in Vol. 194, Page 63 of the Record of Maps for Harris County, Texas; and WHEREAS, Ervin H. Boessling is the abutting land owner and has made application that a portion be discontinued, closed and abandoned as a dedicated overhead utility easement; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: The property to be abandoned is described as follows: BEGINNING at the Southeast corner of Lot 16, a common point with the Southwest corner of Lot 17 of the Whispering Pines, Section 1 Subdivision of the City of Baytown, Harris County, Texas, as a point of beginning; THENCE, in a Northeasterly direction running above and either side of the boundary line between Lot 16 and Lot 17 and comprising the 10 foot by 20 foot overhead utility easement, for a distance of approximately 115 feet. A map of such property to be abandoned is attached hereto and marked Exhibit "A ". Section 2: That the portion of the dedicated overhead utility easement described above is hereby closed, abandoned and permanently vacated as a dedicated easement. Section 3: That the interest of interests of the City and /or public in the above described portion of said easement (and as shown in Exhibit "A" attached hereto) is hereby quitclaimed to the adjacent owner for and in consideration of Six Hundred and No /100 ($600.00) Dollars. Section 4: That the Mayor and City Clerk are hereby authorized to execute such instruments, if any, necessary for such abandonment and sale. 30714 -1a Section 5: That this Ordinance is to become effective from and after its passage by the City Council of the City of Baytown.
