Ordinance No. 3,64530623-1 ORDINANCE NO. 3645 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN AWARDING THE CONTRACT FOR THE ROLLINGBROOK DRIVE IMPROVEMENT PROJECT TO ABLE SERVICES, INC./BAYTEX CONSTRUCTION COMPANY, A JOINT VENTURE, FOR TWO MILLION TWO HUNDRED THIRTEEN THOUSAND THREE HUNDRED TEN AND NO/100 ($2,213,310.00) DOLLARS; DIRECTING THAT NO WORK BE STARTED ON SAID PROJECT UNTIL COMPLETION OF THE ASSESSMENT PROCEEDINGS; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, by Ordinance No. 3610 Council did determine the necessity for and ordered the permanent improvement of Rollingbrook Drive; and WHEREAS, a part of the costs of this improvement are proposed to be assessed against the property and owners of property abutting Rollingbrook Drive; and WHEREAS, the City Council did authorize advertising for bids for the Rollingbrook Drive Improvement Project to be received June 21, 1983; and WHEREAS, notice to bidders as to the time and place, when and where the contract would be let was published pursuant to provisions of Section 74 of the Charter of the City of Baytown; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 o'clock a.m., Tuesday, June 21, 1983, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of Able Services, Inc./Baytex Construction Company, A Joint Venture, for the sum of Two Million Two Hundred Thirteen Thousand Three Hundred Ten and No/100 ($2,213,310.00) Dollars, and the Mayor and City Clerk are hereby authorized and directed to execute and attest to a contract with Able Services, Inc./gaytex Construction Company, A Joint Venture, for the Rollingbrook Drive Improvement Project, said contract containing the plans, specifications, and requirements of the Consulting Engineers and appropriate bond provisions in accordance with the requirements of TEX. REV. CIV. STAT., art. 5160. Section 2. That no work shall be started on this project until completion of the assessment proceedings. 30623--1a Section 3: That pursuant to the provisions of TEX. REV. CIV. STAT. art. 2368a, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of Fifteen Thousand and No/100 ($15,000.00) Dollars or less, provided that the original contract price may not be increased by more than twenty-five (25%) percent or decreased by more than twenty-five (25%) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect from and after its passage.
