Ordinance No. 3,64430609 -6 ORDINANCE NO. 3644 AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO MAKE OFFERS FOR AND ON BEHALF OF THE CITY OF BAYTOWN TO THE OWNERS OR OTHER PARTIES IN INTEREST FOR THE ACQUISITION OF CERTAIN TRACTS DESCRIBED HEREIN REQUIRED FOR DRAINAGE PURPOSES; REQUIRING THAT SUCH OFFERS BE ACCEPTED WITHIN FIFTEEN (15) DAYS; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS IN THE EVENT SUCH OFFERS ARE REFUSED; AND PROVIDING FOR THE EFFECTIVE DATE HEREOF. WHEREAS, the City Council of the City of Baytown now finds and determines that public convenience and necessity require that the City of Baytown acquire the tracts described below; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Attorney be and he is hereby authorized and directed to make the offers listed below to the below named owners, or other parties in interest believed to be the true owners of said property, or to the actual real and true owners thereof, whether correctly named or not, for the purchase and acquisition by the City of Baytown of an easement under, across and through the said tracts that are required for drainage purposes within the City of Baytown: TRACT #1 The South ten feet of Lot 14, Block 3, Plumwood Section 5; Baytown, Harris County, Texas. OWNER Mr. John J. Seligman Jr. TRACT #2 OFFER .107 acres out of the William Scott Survey, A -65, Harris County, Texas, as described in the attached Exhibit "A ". OWNER OFFER Mr. Charles R. Seligman $ 750.00 Section 2: Such offers shall provide that if the offers should not be accepted within fifteen (15) days after receipt, the City of Baytown will consider such offers refused and will institute condemnation proceedings on behalf of the City of Baytown under any applicable provision of the law, whether provided by Title 52 of the Revised Civil Statues, Chapter 17 of Title 28 of said Statutes, the Charter of the City of Baytown, or any other provisions. 30609 -6a Section 3: Should such offers be accepted, the money above set forth shall be paid out of any appropriation heretofore made for the public purpose for which the above described tracts are required. Should such offers not be accepted, the an-iount finally awarded to the owners in the condemnation proceedings, plus costs, fees, and expenses, shall be paid out of such funds so appropriated. Section 4: This ordinance shall take effect from and after its passage.
