ORDINANCE NO. 3644
AN ORDINANCE AUTHORIZING THE CITY ATTORNEY TO MAKE
OFFERS FOR AND ON BEHALF OF THE CITY OF BAYTOWN TO THE
OWNERS OR OTHER PARTIES IN INTEREST FOR THE ACQUISITION
OF CERTAIN TRACTS DESCRIBED HEREIN REQUIRED FOR
DRAINAGE PURPOSES; REQUIRING THAT SUCH OFFERS BE
ACCEPTED WITHIN FIFTEEN (15) DAYS; DIRECTING THE CITY
ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS IN THE
EVENT SUCH OFFERS ARE REFUSED; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, the City Council of the City of Baytown now finds and determines
that public convenience and necessity require that the City of Baytown acquire the
tracts described below; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Attorney be and he is hereby authorized and
directed to make the offers listed below to the below named owners, or other
parties in interest believed to be the true owners of said property, or to the actual
real and true owners thereof, whether correctly named or not, for the purchase and
acquisition by the City of Baytown of an easement under, across and through the
said tracts that are required for drainage purposes within the City of Baytown:
TRACT #1
The South ten feet of Lot 14, Block 3, Plumwood Section 5; Baytown,
Harris County, Texas.

.107 acres out of the William Scott Survey, A -65, Harris County, Texas,
as described in the attached Exhibit "A ".

Section 2: Such offers shall provide that if the offers should not be accepted
within fifteen (15) days after receipt, the City of Baytown will consider such offers
refused and will institute condemnation proceedings on behalf of the City of
Baytown under any applicable provision of the law, whether provided by Title 52 of
the Revised Civil Statues, Chapter 17 of Title 28 of said Statutes, the Charter of
the City of Baytown, or any other provisions.

Section 3: Should such offers be accepted, the money above set forth shall
be paid out of any appropriation heretofore made for the public purpose for which
the above described tracts are required. Should such offers not be accepted, the
an-iount finally awarded to the owners in the condemnation proceedings, plus costs,
fees, and expenses, shall be paid out of such funds so appropriated.
Section 4: This ordinance shall take effect from and after its passage.
INTRODUCED, READ, and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 9th day of June , 1983.

FIELD NOTES
WILLIAM SCOTT LOWER LEAGUE
ABSTRACT No. 65, TRACT 80
BEING a tract or parcel of land containing 0.107 acres of land in the
William Scott Lower League, Abstract No. 65 and lying wholly within that
certain 7.0 acre tract as conveyed to Charles R. Seligman and recorded
on Film Code No. 193 -92 -0980 thru 193 -92 -0981 on August 25, 1981 of the
Deed Records of Harris County, Texas, said 0.107 acre tract being a 15.0
foot wide drainage easement and which is more particularly described by
metes and bounds as follows:
BEGINNING at a stake for the Northwest corner of the aforementioned 7.0
acre tract;
THENCE, South 649 45' 00" East along the North property line of the afore-
mentioned 7.0 acre tract for a distance of.15.0 feet to a point for a
corner;
THENCE, South 21° 30' 00" West along a line that is 15.0 feet and East of
the West property line of the 7.0 acre tract for a distance of 310.0 feet
to a point for a corner;
THENCE, North 64° 45' 00" West for a distance of 15.0 feet to a point for
a corner on the common property line of the aforementioned 7.0 acre tract
and Plumwood, Section 5, Subdivision;
THENCE, North 210 30' 00" East along the common property line as mentioned
above for a distance of 310.0 feet to the Point of Beginning, being a
tract of land containing 0.107 acres of land, more or less.
