ORDINANCE NO. 3643
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR TO
EXECUTE AND THE CITY CLERK TO ATTEST TO A CONTRACT WITH
GENERAL TELEPHONE COMPANY OF THE SOUTHWEST FOR THE
PURCHASE OF LAND; AUTHORIZING PAYMENT BY THE CITY OF
TEN THOUSAND SIX HUNDRED AND NO /100 ($10,600.00) DOLLARS;
AND PROVIDING FOR THE EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the City Council of the City of Baytown, Texas, hereby
approves a Contract to purchase land for a radio tower site from General Telephone
Company of the Southwest and authorizes the Mayor and City Clerk of the City of
Baytown to execute and attest to said Contract. A copy of said Contract is
attached hereto, marked Exhibit "A ", and made a part hereof for all intents and
purposes.
Section 2: That the City Council hereby authorizes payment of $10,600.00 to
General Telephone Company of the Southwest as the purchase price for the land.
Section 3: That this Ordinance shall take effect from and after its passage.
INTRODUCED, READ and PASSED by the affirmative vote of the City
Council of the City of Baytown, this the 9th day of June , 1963.

THE STATE OF TEXAS
SALE CONTRACT
COUNTY OF TOM GREEN
THIS CONTRACT, made and entered into in duplicate
originals by and between GENERAL TELEPHONE COMPANY OF THE
SOUTHWEST, a Delaware corporation, P. 0. Box 1001, San Angelo,
Texas 76902 -1001, hereinafter called "Seller," and CITY OF
BAYTOWN, P. 0. Box 424, Baytown, Texas 77520, hereinafter called
"Purchaser."
W I T N E S S E T H:
1. The Seller hereby covenants and agrees to sell and
convey to Purchaser by General Warranty Deed for the agreed
consideration of EIGHT THOUSAND FIVE HUNDRED DOLLARS ($8,500.00),
of which Purchaser has placed in escrow with General Telephone
Company of the Southwest the sum of FIVE HUNDRED DOLLARS ($500.00)
as escrow deposit on this transaction, and the balance of the
consideration to be paid in cash upon delivery of the Deed, the
following- described real property lying and being situate in the
County of Harris, State of Texas, more particularly described as
follows, to -wit:
BEING a parcel of land out of the George Ellis
Survey, Abstract Number 21, Harris County, Texas,
also being a portion of that certain 20 acre tract
conveyed to General Telephone Company of the
Southwest by Lena F. Johnson and others by deed
recorded in Volume 7039 at Page 522 of the Deed
Records of Harris County, Texas, and being more
particularly described by metes and bounds as
follows:
COMMENCING at the Southwest corner of the above -
mentioned 20.00 acre tract said corner being
located in the East right -of --way line of North
Main Street;
THENCE North 82 026117" East with the South line of
the abovementioned 20.00 acre tract a distance of
1081.55 feet to a 1/2 inch iron rod marking the
POINT OF BEGINNING, also being the Southwest
corner of the tract described herein;

THENCE continuing North 82 °26'17" East with the
South line of the abovementioned 20.00 acre tract
a distance of 77.69 feet to a 5/8 inch iron rod
found for an angle point;
THENCE North 64 °01'40" East with the South line of
the abovementioned 20.00 acre tract a distance of
145.56 feet to a 5/8 inch iron rod found marking
the Southeast corner of the said 20 acre tract and
the herein described tract;
THENCE North 08 004'12" West with the East line of
the abovementioned 20.00 acre tract a distance of
170.22 feet to a 1/2 inch iron rod set for marking
the Northeast corner;
THENCE South 82 °26'17" West with the North line of
this tract a distance of 216.21 feet to a 1/2 inch
iron rod set for marking the Northwest corner;
THENCE South 08 004'12" East with the West line of
this tract a distance of 216.19 feet to the POINT
OF BEGINNING enclosing a tract of land containing
1.0000 acres, more or less.
2. Should the Purchaser fail to complete this Contract
as specified for any reason except title defects, Seller shall
have the right to retain the escrow deposit as liquidated damages.
3. Seller agrees to furnish Purchaser at closing a
General Warranty Deed.
4. It is agreed that taxes for the current year shall
be prorated between the parties as of the date of closing the
transaction. Proration of taxes on which rates have not been
fixed shall be accomplished on the basis of tax rates for the next
preceding year, applied to the most recent assessed valuation.
5. This Contract shall inure to the benefit of and be
binding upon the parties, their respective heirs, executors,
administrators, successors and assigns.

6. This agreement is subject to approval by Seller's
Board of Directors.
