ORDINANCE NO. 3641
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, DECLARING THAT AN EMERGENCY SITU-
ATION EXISTS; APPROVING THE HIRING OF CHANNEL
CONSTRUCTION COMPANY TO MAKE EMERGENCY REPAIRS TO
THE SANITARY SEWER LINE ON BAYSHORE DRIVE; AUTHOR-
IZING THE PAYMENT OF THE SUM OF TWENTY SIX THOUSAND
THIRTY EIGHT AND 02/100 ($26,038.02) DOLLARS WITH REGARD
TO SUCH EMERGENCY REPAIRS; AND PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
WHEREAS, a major sanitary sewer line on Bayshore Drive became stopped
and required immediate attention; and
WHEREAS, the sliplining of this line was necessary for the preservation and
protection of the health, welfare, and safety of the citizens of the City of
Baytown; and
WHEREAS, TEX. REV. CIV. STAT. art. 2368a provides that in the event it
becomes necessary to appropriate money at once to protect the public health of the
citizens of the City of Baytown, the requirement of competitive bids is not appli-
cable; and
WHEREAS, the City Administration hired Channel Construction Company to
make these emergency repairs; and
WHEREAS, considering the above, the City Council of the City of Baytown
deems that an emergency situation exists and wishes to approve the Administration's
hiring of Channel Construction Company to make these emergency repairs and the
payment of $26,038.02 as the cost of such repairs; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,

Section 1: That the City Council of the City of Baytown, Texas, hereby
declares that an emergency situation exists.
Section 2: That the hiring of Channel Construction Company to make
emergency sliplining repairs of the sanitary sewer line on Bayshore Drive is
approved, and the payment of the sum of Twenty Six Thousand Thirty Eight and
02 /100 ($26,038.02) Dollars is hereby authorized.
Section 3: This ordinance shall take effect from and after its passage by the
City Council of the City of Baytown.
