Ordinance No. 3,638PUBLISHED: The Baytown Sun 30609 °1 Tuesday, June 14, 1983 Wednesday, June 15, 1983 ORDINANCE N0. 3638 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN PROVIDING FOR THE REMOVAL OF THE TRAFFIC CONTROL SIGNAL AT THE INTERSECTION OF COMMERCE STREET AND WEST TEXAS AVENUE; DESIGNATING THE INTERSECTION OF COMMERCE STREET AT WEST TEXAS AVENUE AS A STOP INTERSECTION; AUTHORIZING THE PLACING AND MAINTAINING OF STOP SIGNS ON COMMERCE STREET AT WEST TEXAS AVENUE; REPEALING ORDINANCES INCONSISTENT HEREWITH; CONTAINING A SAVINGS CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO HUNDRED AND NO /100 ($200.00) DOLLARS FOR EACH VIOLATION; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE HEREOF. WHEREAS, TEX. REV. CIV. STAT. ANN. art. 6701d, provides that local authorities in their respective jurisdiction may place and maintain any traffic control device upon any highway under their jurisdiction as they may deem necessary to regulate, warn, or guide traffic; and WHEREAS, the City Council of the City of Baytown, Texas, deeming it necessary to regulate, warn and guide traffic at the intersection herein described; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN: Section 1: The following described intersection shall no longer be controlled by a traffic control signal, to -wit: Commerce Street and West Texas Avenue. Section 2: The following described intersection is hereby designated a stop intersection, to -wit: Commerce Street at West Texas Avenue. Section 3: The Director of Planning and Traffic is hereby authorized and directed to cause the removal of the traffic control signal and to place and maintain the stop signs at the above prescribed location. Section 4: All ordinances or parts of ordinances inconsistent with the terms of this ordinance are hereby repealed, provided however, that such repeal shall be only to the extent of such inconsistency and in all other respects this ordinance shall be cumulative of other ordinances regulating and governing the subject matter covered by this ordinance. 30609 -1a Section 5: If any provision, section, exception, subsection, paragraph, sentence, clause or phrase of this ordinance or the application of same to any person or set of circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall not affect the validity of the remaining provisions of this ordinance or their application to other persons or sets of circumstances and to this end all provisions of this ordinance are declared to be severable. Section b: It shall be unlawful for a driver of a vehicle to disobey the instructions of the signs placed in accordance with the provisions of this ordinance, unless at the time otherwise directed by a police officer or traffic control signal. Section 7: Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be punished by a fine of not less than One and NO /100 ($1.00) Dollar nor more than Two Hundred and NO/100 ($200.00) Dollars except minors who have passed their 14th birthday but have not reached their 17th birthday shall be punished by a fine of not more than One Hundred and NO /100 ($100.00) Dollars. Section S: This Ordinance shall take effect from and after ten (10) days from its passage by the City Council. The City Clerk is hereby directed to give notice hereof by causing the caption of this ordinance to be published in the official newspaper of the City of Baytown at least twice within ten (10) days after the passage of this ordinance.
