ORDINANCE NO. 3628
AN ORDINANCE AMENDING SECTION 31-55 "WATER TAPPING
FEES" OF THE CODE OF ORDINANCES TO REQUIRE PAYMENT
OF THE CURRENT COSTS OF WATER TAPPING FEES:
AMENDING SECTION 31-67 "SEWER TAPPING FEES" TO REQUIRE
PAYMENT OF THE CURRENT COSTS OF SOME TAPPING FEES;
AMENDING SECTION 31 -59 "PROCEDURES AND REMEDIES FOR
NON - PAYMENT OF WATER BILLS AND VIOLATIONS OF CITY
ORDINANCES" TO INCREASE THE CHARGE FOR BAD CHECKS;
PROVIDING FOR THE REPEAL OF INCONSISTENT ORDINANCES;
CONTAINING A SAVINGS CLAUSE; PROVIDING FOR THE
EFFECTIVE DATE HEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section l: That the Code of Ordinances of the City of Baytown, Texas, is hereby
amended by adding a section, to be numbered Section 31 -55 (c), which section reads
as follows:
Section 31 -55: Water Tapping Fees.
(c) If a
person pays for a water tap
and fails to
have the
tap made
within one (1) year from
the date such
tap fee is
paid, the
City shall not allow the
water tap to
be made
Unless
the person requesting the
tap pays such
additional
amount
necessary to increase the original
payment
to the
current
cost of a water tap.
Section 2: That the Code of Ordinances of the City of Baytown, Texas is
hereby amended by adding a section, to be numbered Section 31 -67 (d), which section
reads as follows:
Section 31 -67. Sewer Tapping Fees.
(d) If a person pays for a sewer tap and fails to have the
tap made within one (1) year from the date such tap fee is
paid, the City shall not allow the sewer tap to be made
unless the person requesting the tap pays such additional
amount necessary to increase the original payment to the
current cost of a sewer tap.
Section 3: That Section 31 -59 (d) of the Code of Ordinances of the City of
Baytown, Texas, is hereby amended to read as follows:
Section 31 -59: Procedures and remedies for nonpayment of
water bills and violations of City ordinances.
(d) Should any person give the City a check in payment of
water services which is not honored by the drawee bank for
any reason, an additional charge of Ten and NO /100
($10.00) Dollars shall be charged to the person giving such
check.

Section 4: All ordinances or parts of ordinance inconsistent with the terms
of this ordinance are hereby repealed; provided however, that such repeal shall be
only to the extent of such inconsistency and in all other respects this ordinance
shall be cumulative of other ordinances regulating and governing the subject matter
covered by this ordinance.
Section 5: If any provisions, section, exception, subsection, paragraph,
sentence, clause or phrase of this ordinance or the application of same to any
person or set of circumstances, shall for any reason be held unconstitutional, void or
invalid, such invalidity shall not affect the validity of the remaining provisions of
this ordinance or their application to other persons or sets of circumstances and to
this end all provisions of this ordinance are declared to be severable.
Section 6: This ordinance shall take effect from and after its passage.
