Ordinance No. 3,50921111 -11 ORDINANCE NO. 3509 AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH MCKINNEY & JAMES & CO.,INC.,FOR THE CON- STRUCTION OF A SANITARY SEWER LINE ON GARTH ROAD AND MAKING OTHER PROVISIONS RELATED THERETO. WHEREAS, the City Council of the City of Baytown did authorize the City Engineer to advertise for bids for the construction of sanitary sewer on Garth Road from the lift station to a point 750' South to be received November 1, 1982; and WHEREAS, notice to bidders as to the time and place, when and where the contract for said construction would be let was published pursuant to provisions of TEX. REV. CIV. STAT. art. 2368a; and WHEREAS, all bids were opened and publicly read at City Hall at 10:00 a.m., on Monday, November 1, 1982, as per published notice to bidders; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That the City Council of the City of Baytown hereby accepts the bid of McKinney & James & Co., Inc., according to the plans and specifications set forth by the City Engineer for the sum of Twenty Three Thousand Six Hundred Seventy Five & 40/100 (23,675.40) Dollars, and the Mayor and City Clerk of the City are hereby authorized and directed to execute and attest to a contract with McKinney & James & Co., Inc. for the sanitary sewer line on Garth Road, containing the plans, specifications, and requirements of the City Engineer and appropriate bond provisions in accordance with the provisions of TEX. REV. CIV. STAT. art. 5160. Section 2: That the award of this contract is contingent upon the receipt of $23,675.40 from Pay Less Cashways. Section 3: That pursuant to the provisions of TEX. REV. CIV. STAT. art. 2368a, the City Manager is hereby granted general 21111 -11a authority to approve any change order involving a decrease or an increase in costs of Fifteen Thousand and No /100 ($15,000.00) Dollars or less, subject to the provisions that the original contract price may not be increased by more than twenty -five (25) percent or decreased by more than twenty -five (25 %) percent without the consent of the contractor to such decrease. Section 4: This ordinance shall take effect from and after its passage.
